Menara Construction Referral Program – Terms & Conditions

1. Overview
Menara Construction ("we," "us," "our") offers a referral program ("Referral Program") to individuals who refer potential clients ("Referee") to us. By participating in this program, Referees agree to comply with the following Terms & Conditions.
This program applies to all our services, including:
New Builds
Renovations

2. Referral Rewards
2.1 New Builds
Referees will earn the following referral fees based on the total GST-inclusive contract value:

1% for contracts above NZD 1,000,000 (incl. GST)

1.25% for contracts below NZD 1,000,000 (incl. GST)
2.2 Renovations
For renovation projects, referral fees will be calculated as follows:

Up to 3% for renovation contracts under NZD 500,000 (incl. GST) (exact percentage to be confirmed upon contract signing)

2% for renovation contracts above NZD 500,000 (incl. GST)
Referral fees are paid in NZD and will be subject to applicable taxes under New Zealand law.

3. How to Make a Valid Referral
To be eligible for referral fees, Referees must adhere to the following process:

Pre-registration of Referral

The Referee must email Menara Construction before the potential client contacts us.

The email must be sent to [Menara Construction’s official email] and include:

Referee’s full name and contact details
-
The full legal name of the referred client or company name (this must match the name that will appear on the building contract)

A statement that this is a referral case

Client Contact & Contract Signing
-
If the potential client reaches out to us before we receive the referral email, the referral will be deemed invalid.

The referral is only considered valid if the referred client signs a binding building contract with Menara Construction.

3.1 Acceptance of Terms & Conditions
By submitting the potential client’s name, the Referee automatically agrees to these Terms & Conditions.

4. Payment Terms & Conditions
4.1 Calculation of Referral Fees

Referral fees are based on the GST-inclusive contract value.

If the contract amount is later amended, the referral fee will be adjusted accordingly.
4.2 Payment Structure
Referral fees will be paid in two stages:

50% of the referral fee is paid when:
-
The contract is signed, and
-
The deposit has been received by Menara Construction.

50% of the referral fee is paid when:
-
The project has passed the final council inspection.

4.3 Payment Method

All referral fees will be paid via bank transfer only.

The Referee must provide valid bank account details to receive payment.

5. Eligibility & Exclusions

The Referral Program is only open to individuals or companies legally allowed to receive referral fees under New Zealand law.

Employees, contractors, and business partners of Menara Construction are not eligible for referral fees.
-
Referral fees are not applicable for clients already in negotiation with Menara Construction before the referral is submitted.

6. Legal & Tax Compliance

Tax Obligations: Referees are responsible for their own tax obligations. Referral fees are subject to taxation, and Menara Construction may withhold taxes as required by New Zealand law.

Anti-Bribery & Fair Competition: Referrals must be made in good faith. Any attempt to manipulate the program or misrepresent client relationships will result in disqualification.

Dispute Resolution: In case of any disputes, parties agree to resolve them amicably first. If unresolved, disputes will be handled under New Zealand law.

7. General Terms

Menara Construction reserves the right to modify, suspend, or terminate this Referral Program at any time.

The Referral Program is valid only for contracts signed within New Zealand.

By submitting the name of a potential client, the Referee acknowledges and agrees to these Terms & Conditions.
